Required elements of a takedown notice

Under 17 U.S.C. § 512(c), a valid notice must include all of the following. Incomplete notices will be returned unprocessed.

  1. A physical or electronic signature of the copyright owner (or a person authorized to act on their behalf).
  2. Identification of the copyrighted work claimed to be infringed (e.g., registration number, a URL to the original, or a clear description).
  3. Identification of the allegedly infringing material and its location on Clutch (include the full URL).
  4. Contact information — name, mailing address, telephone, and email.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on behalf of the owner.

Counter-notice

If your content was removed and you believe the removal was a mistake or misidentification, you may send a counter-notice to the same address. A valid counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the URL where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
  4. Your name, mailing address, and telephone; plus consent to the jurisdiction of the federal district court for your address (or, if outside the U.S., any district in which Clutch may be found), and agreement to accept service of process from the original notifier.

On receipt of a valid counter-notice, we will forward it to the original notifier. If they do not file a court action within 10 to 14 business days, we will restore the content.

Repeat-infringer policy

Accounts that accrue repeated, verified infringement notices will be terminated and their uploads removed. Fraudulent notices and counter-notices are actionable under § 512(f).

Trademark, patent, and trade-dress claims

Those claims fall outside the DMCA. Email legal@clutch.parts with the specific registration or filing and the allegedly infringing URL.
