Terms of service

Version 0.1 — preview. These terms are a good-faith summary of our current expectations and may be revised as the platform develops. Using the platform means you accept the current version as written.

1. Who we are

Clutch Inc. (“Clutch”, “we”) operates an online marketplace for 3D-printable car parts. These Terms govern your use of the site, APIs, and any related services (collectively, the “Service”).

2. Eligibility and accounts

  • You must be at least 13 (16 in the EU) to use the Service and at least 18 to pledge, sell, or receive payouts.
  • You are responsible for your credentials. Notify us immediately if you suspect unauthorized use.
  • One natural person per account. Printers may register a business entity as the account holder.

3. Your content and the license you grant us

You retain ownership of the parts, images, and text you upload. When you upload, you grant Clutch a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your content on the Service, subject to the license you select (CC0, CC-BY, CC-BY-NC, CC-BY-SA, CC-BY-ND, CC-BY-NC-SA, CC-BY-NC-ND, or Proprietary).

Bounty submissions must be licensed CC0 or CC-BY so pledgers can freely use and redistribute what they funded.

4. Payments, pledges, refunds

  • All payments are processed by Stripe. You authorize immediate capture of posting fees and print-order totals. Bounty pledges are not charged when you pledge: we save your card and you authorize us to charge it later, off-session, only if and when a designer delivers the part and the bounty settles. We email you before that charge is made.
  • Pledges may be withdrawn while the bounty is OPEN. After fulfillment acceptance or auto-release, pledges are non-refundable except at our discretion or as required by law.
  • Print orders may be cancelled until the printer marks the order PRINTING. After that, cancellation is at the printer’s discretion. On a cancellation or a printer decline we refund everything except the $0.59 platform fee, which covers the payment-processing cost we incur and do not get back. Where we refund you for a defective or undelivered print, the $0.59 is refunded too.
  • Platform fee: 10% of each bounty pool (minimum $5), 12% of each print-order subtotal, and a flat $0.59 per print order added to your total at checkout. Designers earn an ongoing royalty on every print order — 5% for bounty-funded parts, 3% for independent uploads. See /how-it-works#bounties for the full economics.

5. Acceptable use

You agree to follow the Acceptable Use Policy. Violations can result in content removal, refund reversal, or account termination.

6. Safety disclaimer — READ CAREFULLY

3D-printed parts are not certified automotive components. Parts flagged FLAGGED_SAFETY (brakes, steering, restraints, structural) can fail catastrophically if designed, printed, or installed incorrectly, causing injury or death.

  • Safety-flagged parts cannot be ordered as prints through Clutch. They are download-only. We take no fee and route no order for a part in that category, whether or not a reviewer has verified it.
  • Use parts at your own risk. Clutch does not certify fit, function, strength, or legal roadworthiness of any community upload.
  • Have safety-critical parts installed and inspected by a qualified automotive professional.
  • You alone are responsible for compliance with local vehicle codes, emissions laws, and insurance terms.

7. Intellectual property

Do not upload content that infringes a third party’s copyright, trademark, patent, or trade-dress rights. See our DMCA policy for how rights holders can request a takedown.

8. Termination

We may suspend or terminate your account for violations, fraud, or legal risk. You may close your account at any time; pending transactions and retained financial records (Section 10 of the Privacy Policy) survive termination.

9. Disclaimers

The service is provided “as is.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

10. Limitation of liability

To the fullest extent permitted by law, Clutch’s total liability for any claim arising from the service is limited to the greater of $100 or the total fees you paid us in the prior 12 months. We are not liable for indirect, incidental, consequential, or punitive damages.

11. Indemnification

You agree to indemnify and hold Clutch harmless from claims arising out of your content, your use of the Service, or your violation of these Terms.

12. Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Any dispute will be resolved by binding arbitration under JAMS rules, except that either party may seek injunctive relief in court. Class actions are waived to the extent allowed by law.

We will post revised Terms here with an updated date. Material changes will be announced by email.
